Terms of Service

1. Acceptance of Terms

By creating an account, joining our early-access list, accessing Twundle, or using any Twundle services (“Services”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the Services.

These Terms form a legally binding agreement between you and Twundle (“we,” “us,” “our”).

2. Eligibility

To use Twundle, you must:

• Be at least 18 years old
• Have the legal capacity to enter a contract
• Not be prohibited from using online services under applicable law
• Not have been previously removed or banned from Twundle

You represent that all information you provide is accurate and truthful.

3. Account Creation & Security

You are responsible for:

• Maintaining the confidentiality of your login credentials
• All activity occurring under your account
• Notifying us immediately of unauthorized access

You may not:

• Create multiple accounts
• Create an account for someone else
• Use another person’s account
• Sell, rent, or transfer your account

We reserve the right to suspend or terminate accounts for violations of these Terms.

4. Personal Use Only

Twundle is for personal, non-commercial use.

You may not use the Services to:

• Advertise products or services
• Recruit users for other platforms
• Conduct research without consent
• Scrape or harvest data

5. User Content

You retain ownership of the content you upload (“User Content”).

By using the Services, you grant Twundle a non-exclusive, worldwide, royalty-free license to:

• Display your content within the Services
• Distribute it to other users
• Use it to operate and improve the Services

We do not sell your photos, messages, or profile data to third parties.

You agree that your content will not:

• Contain nudity, pornography, or sexually explicit material
• Promote hate, violence, or harassment
• Include copyrighted material you do not own
• Impersonate another person
• Include private information of others
• Include links to other websites or services in messages

We review photos before they are shown to other members, and we may remove content that violates these rules.

6. Prohibited Conduct

You may not:

• Harass, threaten, or abuse other users
• Use the platform for fraud or scams
• Engage in doxxing or stalking
• Use bots, automation, or scraping tools
• Attempt to reverse engineer the Services
• Interfere with the platform’s operation, including by exceeding the limits we place on how often an action can be taken

We may investigate and take action, including account termination. Our Community Guidelines describe the conduct we expect in more detail and form part of these Terms.

7. Safety & User Responsibility

Twundle does not conduct criminal background checks.

We do not guarantee the identity, intentions, or behavior of users.

You agree to:

• Exercise caution when interacting with others
• Not share financial information
• Meet in public places for in-person interactions
• Report suspicious or harmful behavior

Twundle is not responsible for user interactions on or off the platform. Our Safety Tips explain how to protect yourself.

8. Subscriptions, Billing & Auto-Renewal

Some features require a paid subscription.

Promotional offers, such as our Founding Offer, have their own terms, which apply alongside these.

8.1 Auto-Renewal

Paid subscriptions automatically renew unless canceled before the renewal date.

8.2 Billing

You authorize us, or the app store you purchase through, to charge your payment method for recurring fees.

8.3 Cancellation

You may cancel at any time through:

• The app store where you purchased the subscription
• Your Twundle account settings (if purchased directly)

Cancellations take effect at the end of the current billing cycle.

8.4 Refunds

Refunds are handled according to:

• App store policies (Apple, Google)
• Applicable state laws
• Our refund policy (if purchased directly)

Some jurisdictions provide additional cancellation rights; we honor all applicable laws.

9. Included Features & In-App Items

Features included with an account or subscription, such as Priority Likes, are:

• Non-refundable
• Non-transferable
• Of no cash value
• Subject to change or discontinuation at any time

Unused allowances do not carry over from one period to the next unless we say otherwise.

10. Privacy & Data Practices

Your privacy is central to Twundle.

We will never:

• Sell your personal data
• Share your photos with third-party advertisers
• Show other members your precise location
• Misrepresent our data practices

We may collect and use data to:

• Operate the Services
• Improve features
• Prevent fraud and abuse
• Personalize your experience

11. Automated Tools

Twundle may use automated tools to:

• Order the profiles shown to you
• Detect spam, scams, and abusive behavior
• Assist with reviewing photos and other content

Automated tools do not make the final decision to remove an account; safety-critical decisions are reviewed by a person.

12. Intellectual Property

All Twundle branding, logos, software, and content (excluding User Content) are owned by Twundle and protected by copyright, trademark, and other laws.

You may not:

• Copy
• Modify
• Distribute
• Reverse engineer
• Create derivative works

without our written permission. Our Intellectual Property Policy explains how to report infringement.

13. Third-Party Services

Twundle relies on third-party services (e.g., hosting, email delivery, payment processors, app stores).

We are not responsible for their actions or policies.

14. Disclaimers

Twundle is provided “as is” and “as available.”

We do not guarantee:

• Successful matches
• Accuracy of user profiles
• Continuous availability
• Error-free operation

To the fullest extent permitted by law, we disclaim all warranties.

15. Limitation of Liability

To the maximum extent permitted by law:

• Twundle is not liable for damages arising from user interactions
• Twundle is not liable for lost profits, data loss, or emotional distress
• Our total liability will not exceed the amount you paid in the last 12 months

Some jurisdictions do not allow certain limitations; those rights remain unaffected.

16. Indemnification

You agree to indemnify and hold Twundle harmless from claims arising from:

• Your use of the Services
• Your User Content
• Your violation of these Terms

17. Termination

We may suspend or terminate your account for:

• Violating these Terms
• Unsafe or harmful behavior
• Fraudulent activity
• Legal compliance reasons

You may delete your account at any time. Your Data & Account Deletion explains how.

18. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of North Carolina, USA.

18.1 Arbitration

Except where prohibited, disputes will be resolved through binding arbitration, not court.

18.2 Exceptions

You may bring claims:

• In small claims court
• For injunctive relief related to intellectual property

19. Changes to These Terms

We may update these Terms periodically.

We will notify you of material changes through the Services or by email.

Continued use of the Services constitutes acceptance of updated Terms.
